Right of Withdrawal

Consumers have the statutory right of withdrawal, as described in the
cancellation policy. Entrepreneurs are not granted a voluntary
right of withdrawal.

Instructions on Withdrawal

Consumers have a fourteen-day right of withdrawal.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days
without giving any reason. The withdrawal period is fourteen days from
the day on which you or a third party named by you, who is not the
carrier, has taken possession of the last goods. To exercise your right
of withdrawal, you must inform us (Choppy's Food & Non-Food GmbH,
Koldingstraße 1B, 22769 Hamburg, Germany, service@the-aussie-guy.com,
Phone: 040/73440210) by means of a clear declaration (e.g. a letter
sent by post, fax or email or via the "Return item" withdrawal function
in the purchase overview and in the order details by selecting the reason
"Contract withdrawal") of your decision to withdraw from this contract.
You can use the attached model withdrawal form, which is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the
notification of the exercise of the right of withdrawal before the
withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all
payments received from you, including the costs of delivery (with the
exception of the additional costs resulting from your choice of a type
of delivery other than the least expensive standard delivery offered by
us), without undue delay and in any event not later than fourteen days
from the day on which we are informed about your decision to withdraw
from this contract. For this repayment, we will use the same means of
payment that you used for the original transaction, unless expressly
agreed otherwise with you; in no event will you be charged fees for this
repayment. We may refuse repayment until we have received the goods back
or until you have provided proof that you have returned the goods,
whichever is the earlier. You must return the goods to us (Choppy's Food
& Non-Food GmbH, Ahornstraße 120, 25462 Rellingen) or hand them
over without undue delay and in any event not later than fourteen days
from the day on which you inform us of the withdrawal from this
contract. The deadline is met if you send the goods before the period of
fourteen days has expired. You bear the direct costs of returning the
goods. You only have to pay for any loss in value of the goods if this
loss in value is due to handling of the goods that is not necessary for
checking the quality, characteristics and functioning of the goods. The
right of withdrawal does not apply to the following contracts:

Contracts for the supply of goods that are not prefabricated and
for the production of which an individual selection or determination by
the consumer is decisive or which are clearly tailored to the personal
needs of the consumer.
Contracts for the supply of goods that can spoil quickly or whose expiry date would be quickly exceeded.
Contracts for the supply of sealed goods that are not suitable for
return for reasons of health protection or hygiene if their seal has been
removed after delivery.
Contracts for the supply of audio or video recordings or computer
software in a sealed package if the seal has been removed after delivery.
Contracts for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

ALL our products, as stated on the website,
are exclusively genuine Australian originals. This means we import them
directly from Australia, which results in a certain loss of shelf life due to the
long transport. Therefore, our goods cannot be compared with those
from regional German supermarkets, and we want to make people aware of this.
Unfortunately, we have no influence on the best-before dates during import
and have to work with what we receive. Normally,
however, we have goods that are shelf-stable for a minimum of 6 months, but this does not apply
to the entire shipment for the reasons just mentioned.

Products that are not specifically marked and are not on sale generally have a best-before date of at least
4 weeks from the order or more. Anything below that will be marked with a best-before date notice
in the shop and offered at a reduced price.

Through
regular random checks, we ensure that products with a short or expired best-before date are
still in perfect condition and can be consumed without restriction.

Of course, you can return our deposit packaging regularly; we are obliged to collect the deposit, here's more information:

According to the German Packaging Act, we, like every other distributor (manufacturers and importers) of deposit-bearing beverage packaging, are obliged to collect this deposit. Almost all beverage packaging is now subject to a deposit - but there are exceptions for Tetra Paks, among others.
In any case, all cans and PET and glass bottles that we offer in our shop are subject to a deposit without exception. It makes no difference whether they are imported foreign packaging or not. In this respect, we have no choice and would be acting unlawfully if we did not collect the deposit.
Naturally, as a distributor, we are also registered in the German deposit system and authorized to provide our cans and bottles with corresponding additional stickers.

The deposit is, as in any supermarket, collected in addition to the product price. This is shown accordingly in the shop. On eBay, for example, this form of separate display is unfortunately not technically possible. Therefore, this one-way deposit is already included in the final price here.

In any case, you will receive beverage packaging that you can return nationwide at regular collection points for a refund of 25 cents each.
It is true that not every retailer has to take back everything, and smaller retailers (kiosks, petrol stations, etc.) in particular can certainly invoke a special regulation not to take back what they do not already carry in their assortment. However, this is also the case with hundreds of other packages that are in circulation in this country.

Theoretically, we would of course also take back everything we have sold, but in practice, sending empty cans and bottles back and forth is hardly feasible.

Our tip: Don't worry about the cans. In our experience, EVERY regular deposit machine accepts them without any problems. And regarding the glass bottles: Go to the local blue-and-white or yellow-and-blue discounter, among others. But there are regional differences in the North/South divide: The blue-and-white machines in the South accept returns, whereas the blue-and-white ones in the North do not. This is simply due to whether a discounter itself also puts single-use glass bottles on the market or not. And if so, they also take back corresponding bottles via their deposit machines. You can also regularly return all our bottles there. Otherwise, as mentioned, despite resistance, EVERY larger supermarket is also obliged to take back glass bottles - even if it should refuse. This is usually only based on ignorance or possibly on the convenience of the employees. This also applies if the provided machines do not automatically recognize and accept the bottles. In this case, please simply go to the nearest checkout or information desk.
ALL well-known supermarket chains are obliged to take back packaging!
